Section 50(1) of the Central Goods and Services Tax (CGST) Act mandates that interest must be paid if taxes are remitted after the prescribed due date.

  • Applicable Rate: Simple interest is charged at 18% per annum from the day immediately following the due date until the actual date of payment.
  • Crucial Amendment (Net Cash Liability): Following the landmark amendment to Section 50, interest is charged only on the net tax liability paid in cash (via the Electronic Cash Ledger). If you have sufficient Input Tax Credit (ITC) balance in your Electronic Credit Ledger to offset your liability, no interest is levied on the ITC-adjusted portion.
  • Wrong ITC Claim: If a taxpayer wrongly avails and utilizes Input Tax Credit, interest is charged at the higher rate of 24% per annum under Section 50(3).

  • Net GST Cash Payable: ₹50,000
  • Due Date: 20th of the month
  • Actual Date of Filing & Payment: 45 days after due date
  • Turnover Bracket: Under ₹1.5 Crore

1. Interest Calculation:

₹50,000 × (18 ÷ 100) × (45 ÷ 365) = ₹1,109.59

2. Late Fee Calculation:

45 days × ₹50/day = ₹2,250. However, because the taxpayer’s turnover is under ₹1.5 Cr, the fee is strictly capped at ₹2,000.

3. Total Amount Payable:

Tax (₹50,000) + Interest (₹1,109.59) + Late Fee (₹2,000) = ₹53,109.59

1. Can GST interest be waived by filing an appeal or grievance?

No. While the government has occasionally announced amnesty schemes to waive or reduce late fees, statutory interest under Section 50 is strictly compensatory in nature and cannot be waived by tax officers or automated portal requests.

2. What happens if I file GSTR-3B without paying the interest due?

The GST system does not block return submission for unpaid interest. However, the system flags the delayed liability, and interest is automatically populated into Table 5.1 of your subsequent GSTR-3B return. If ignored, the jurisdictional officer can issue an automated DRC-01A intimation.

3. Is interest charged if payment is made on time but return is filed late?

If you deposited funds into your Electronic Cash Ledger before the due date, but failed to file GSTR-3B to debit the ledger, courts and recent GST council clarifications maintain that cash in the government treasury does not represent short tax payment.
